PRIVACY NOTICE

At Citywide Mortgage Associates, Inc., we recognize the importance of safeguarding your privacy and take every precaution to keep your personal, nonpublic information confidential. Protecting our clients’ information is not o­nly our policy, it’s the law. We are required by state and federal law to provide this privacy notice to you. It is intended to inform you about the information we collect and to disclose to you that we may share it with certain Nonaffiliated Third Parties, as well as the members of our Corporate Family. You may opt-out of certain information sharing as described below. However, opting out does not restrict all information sharing. The privacy laws permit several exceptions to allow transfers of information. For example, we can continue to share your name and address with our Corporate Family.

(1) Definitions

In this notice, Citywide Mortgage Associates, Inc. is referred to as we, our and us. This initial privacy notice is for you if you are an individual (not a business) who is either our “Customer” or “Consumer”.

A “Consumer” means any individual who seeks to obtain or obtains a financial product or service from us in isolated transactions with us that are used for personal, family or household use, such as submitting a loan application us.

A “Customer” means any individual who has a continuing relationship with us where we provide o­ne or more financial products or services for your personal, family or household use, such as a home mortgage.

“Nonaffiliated Third Party” means a company that is not part of our “Corporate Family”.

“Corporate Family” (1) any company that we own or control, plus (2) any company that owns or controls us, plus (3) any company that is owned or controlled by the same company that controls us.

(2) Confidentiality and Security of Your Nonpublic Personal Information

We restrict access to Nonpublic Personal Information about you to our employees and agents who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal standards to guard your Nonpublic Personal Information.

(3) Information that We Collect

We collect information, including Nonpublic Personal Information about you, from the following sources:

Information we receive from you o­n applications or other forms; Information about your transactions with us, our Corporate Family, or others; Information we receive from a consumer reporting agency; and Written or verbal communication.

(4) Categories of Information that We Disclose

We may disclose all of the information, as described above, to our Corporate Family and Nonaffiliated Third Parties in accordance with applicable law. We can also share information about you with our affiliates when the information is based solely o­n your transactions with our company. For example, we may disclose your information in the following circumstances: to service or process a financial product or service that you have requested; if necessary to effect, administer or enforce a transaction with you; to protect against or prevent actual or suspected fraud; to a consumer reporting agency in accordance with the Fair Credit Reporting Act; to protect the confidentiality or security of your records; in connection with the sale, merger or transfer of a portion of business or operating unit; and with your consent or at your direction.

(5) Categories of Nonaffiliated Parties to Whom We Disclose

As permitted by law, we may disclose Nonpublic Personal Information about you to our Corporate Family and to Nonaffiliated Third Parties, such as:

· Marketing firms to market our own financial products or services. · Financial Institutions who supply financial products or services. · Processors and servicers of transactions that you request or authorize. · Parties who assist in protecting against fraud or unauthorized transactions. · When responding to judicial process. · To comply with federal, state or local legal requirements.

(6) Categories of Information that We Disclose to Marketing Companies

We are permitted to disclose all of the information we collect, as described above, to companies that perform marketing services o­n our behalf or to other financial institutions with which we have joint marketing agreements, in accordance with applicable law such as insurance companies, insurance agents, mortgage loan service providers, insurance brokers, private mortgage insurers and marketing firms.This enables us to better meet your financial needs.

(7) Information We Can Share About You With Our Corporate Affiliates Unless You Tell Us Not To

Except as indicated above, there is certain information we may share with our Corporate Family unless you tell us not to, including:

· Information we obtain from your applications or other forms, such as: your income, your assets or your marital status. · Information we obtain from a consumer report, such as: your credit score or credit history · Information we obtain to verify representations made by you, such as: your open lines of credit, and · Information we obtain from a person or company regarding their employment, credit, or other relationship with you, such as: your employment history.

The corporate affiliates that may receive this information are:

· Any of its future subsidiaries and affiliates, such as financial service provider companies, trust companies, banks and other financial service companies.

(8) Opt Out Information

If you prefer we not share information with our Corporate Family and if you prefer that we not disclose Nonpublic Personal Information with Nonaffiliated Third Parties you may opt-out of those disclosures.
